Acceptance of the General Terms and Conditions of Sale
https://shop.uffizi.it is a service offered by the ATI for which
Giunti Editore Spa is the authorised representative, with registered office at Via G.B. Pirelli, 30 20124 Milan, Tax Code and registration number in the Milan Companies Register: 80009810484, VAT number 03314600481, Share capital € 8,000,000.00 fully paid in.
Hereinafter, for convenience, reference will always be made to
Shop.uffizi.it.
Preamble: these
“General Terms and Conditions of Sale” and in particular the information referred to in Art. 49 of the
Consumer Code, as provided by
Shop.uffizi.it and shown on the site, shall remain valid and effective until they are amended or supplemented by
Shop.uffizi.it.
The latest updated version of the
General Terms and Conditions is the one available on the website. Any modifications or additions to these General Terms and Conditions shall take effect from the date of their publication on the website.
The
contract (as defined: distance contract pursuant to Art. 45, letter g, of Legislative Decree of 6 September 2005, No. 206, “Consumer Code”) entered into between
Shop.uffizi.it and the
Customer is deemed concluded upon confirmation of the purchase order provided by
Shop.uffizi.it to the Customer via the Internet on the website
Shop.uffizi.it.
This confirmation, together with the online publication of these
General Terms and Conditions of Sale, constitutes “confirmation of the contract concluded on a durable medium” pursuant to Art. 51, paragraph 7, of Legislative Decree 206/2005.
By placing an order, the Customer declares:
- To be a consumer as defined by Art. 3 of the Consumer Code;
- To be of legal age;
- That the data provided for the execution of the Contract are correct and truthful;
- To have read all the information provided during the purchase procedure and to fully accept the general terms and conditions and the payment terms indicated in the purchase procedure.
Copy of the Contract
If the Customer is a
natural person who purchases the goods for non-commercial purposes and not related to their professional activity, once the online purchase procedure has been completed, they shall store these
general terms and conditions of sale in compliance with the rules on distance selling, by printing or saving an electronic copy of this contract.
Exclusion of liability
In the event of non-acceptance, even partial, of an order by
Shop.uffizi.it, any right of the Customer to
compensation or damages is excluded, as is any contractual or non-contractual liability for direct or indirect damage to persons and/or property.
Disclaimer
The product information provided by
Shop.uffizi.it is for information purposes only and
does not in any way replace medical advice or consultation. All information is generally provided by the respective manufacturers or is derived from publications freely accessible to the public. It is therefore recommended to carefully read the list of ingredients, the INCI composition (where present), the warnings and the instructions for use shown on the packaging of each product before using them.
Purchasing procedures
The Customer is guaranteed only and exclusively for the purchase of products present in the
electronic catalogue of
Shop.uffizi.it at the time the order is placed and visible online at the URL https://shop.uffizi.it. It is also specified that the
images illustrating a product information sheet may, in some cases, not fully represent its characteristics and may differ in certain details, such as size, colour or other accessories or details possibly shown in the image. All information relating to the purchase (terms, descriptions, purchase guides, etc.) is to be understood as general informational material, not directly referring to the actual characteristics of a specific product.
Prices
The prices of each item are always inclusive of
VAT. If VAT rates or other indirect taxes are changed, the corresponding variations will be applied, upwards or downwards, to the prices.
Shipping costs, being a flat-rate contribution, are also subject to the applicable VAT. The prices indicated in the catalogue are those that the Customer must effectively pay, plus the shipping costs indicated directly on the order form. The price of the products and the shipping costs are expressed in euros. The total price shown at the end of the order includes shipping costs but does not include any
customs duties and/or additional sales taxes required for importing the goods into a foreign country. Any additional charges relating to customs clearance operations shall be borne exclusively by the recipient of the shipment.
Conclusion of the Contract
The
Contract is concluded when the Customer (who has submitted a purchase proposal by providing the data necessary for the registration of their details, the purchase order and the chosen method of payment) receives communication that the proposal has been accepted. Correct receipt of the order is confirmed by
Shop.uffizi.it by an e-mail sent to the address communicated by the Customer at the time of the order. The
“Customer Order Number” indicated in the confirmation message, together with the date and time of receipt of the order, must be used in any further communication with
Shop.uffizi.it. The Customer undertakes to verify the correctness of all the data entered as described in this document and to promptly notify any corrections.
Non-acceptance
In the event of non-acceptance of the order, for any reason,
Shop.uffizi.it guarantees prompt communication to the Customer by e-mail.
Product availability
All products for sale and present in the electronic catalogue of
Shop.uffizi.it are available at the time of purchase, except in the event of unforeseen unavailability of supplies from the manufacturers and/or suppliers of
Shop.uffizi.it, due to IT errors, stock-outs, unreported depletion of stock, non-delivery due to carrier strikes, non-conformity of the product upon receipt and other unforeseeable causes at the time of acceptance of the order.
Shop.uffizi.it reserves the right to partially refund the unavailable items in orders or to refund the entire order if the missing item is the only product in the order.
Expiry dates
Products with a short expiry date: for some products belonging to end-of-stock batches and periodically on offer in the
Offers section (or “category” of the site), the expiry date is explicitly indicated at the time of purchase, under the item “Best before” visible on the product information sheet. The purchaser is required to check and assess the suitability of such products before purchase and no claims or returns concerning the expiry date will be accepted.
Limits of access to the website
Shop.uffizi.it reserves the discretionary right to prevent, at any time and without notice, access to the
Shop.uffizi.it website, in whole or limited to certain functionalities, for Customer Accounts in which payment irregularities, non-payment, damage to image over the internet, obscene, vulgar or inappropriate language in the review and comment functions, repeated and continuous unsuccessful order attempts, cyber attacks or any other activity, explicit or implicit, that may cause direct or indirect damage to
Shop.uffizi.it have been detected.
Invoice
For each order placed on
Shop.uffizi.it, if the Customer has expressly requested it at the time of ordering and has provided a valid
VAT number or valid
Tax Code when registering their Customer Account,
Shop.uffizi.it will issue an invoice for the goods shipped, sending it by e-mail to the person named on the order, pursuant to Art. 14 of Presidential Decree 445/2000 and Legislative Decree 52/2004. For the details indicated at the time of invoice issuance, only the information provided by the Customer when placing the order shall be valid. No changes may be made to the invoice after it has been issued.
Payment methods
The Customer may choose one of the following payment methods:
Credit Card, PayPal.
Credit Card
If the
“Credit Card” payment method is chosen, upon completion of the online transaction, the reference bank will charge the amount relating to the purchase made.
In the event of cancellation of the order, either by the Customer or in the event of non-acceptance by
Shop.uffizi.it,
Shop.uffizi.it will simultaneously request the cancellation of the transaction and the release of the amount pre-authorised. Release times, for certain types of cards, depend exclusively on the banking system and may extend until the natural expiry of the authorisation (24th day from the date of authorisation). Once the transaction has been cancelled,
Shop.uffizi.it can in no way be held liable for any damage, direct or indirect, caused by a delay or failure in the release of the pre-authorised amount by the banking system.
Shop.uffizi.it reserves the right to debit the Customer’s credit card in order to avoid the expiry of the transaction authorisation, which occurs on the 23rd day.
Shop.uffizi.it reserves the right to request additional information from the Customer (e.g. landline number) or copies of documents proving ownership of the card used. If the requested documents are not provided,
Shop.uffizi.it reserves the right not to accept the order.
At no point during the purchase process is
Shop.uffizi.it able to know the Customer’s credit card information, which is transmitted via a secure connection directly to the website of the bank handling the transaction. No IT archive of
Shop.uffizi.it will store such data. Under no circumstances can
Shop.uffizi.it therefore be held responsible for any fraudulent or improper use of credit cards by third parties when paying for products purchased on
Shop.uffizi.it.
PayPal
When purchasing goods using the
PayPal payment method, upon completion of the online transaction, PayPal will immediately debit the amount relating to the purchase made.
In the event of cancellation of the order, either by the Customer or in the event of non-acceptance of the order by
Shop.uffizi.it, the cancellation will result in the amount relating to the cancelled goods being re-credited to the Customer’s PayPal account. The time required to re-credit the chosen payment instrument within the PayPal account depends exclusively on PayPal and the banking system. Once the amount has been re-credited to the PayPal account,
Shop.uffizi.it can in no way be held liable for any damage, direct or indirect, caused by delays in the actual re-crediting attributable to PayPal or the banking system.
Shop.uffizi.it reserves the right to request additional information from the Customer (e.g. landline number) in order to verify the effective ownership of the PayPal account. In the absence of the requested documentation,
Shop.uffizi.it reserves the right not to accept the order.
At no point during the purchase process is
Shop.uffizi.it able to know the Customer’s credit card information or other instruments used within the PayPal wallet. Under no circumstances can
Shop.uffizi.it therefore be held responsible for any fraudulent or improper use of credit cards by third parties when paying for products purchased on
Shop.uffizi.it.
Delivery of products and shipping costs
Shop.uffizi.it accepts Customer orders within the limits of the quantity of products available in stock. Therefore, delivery of the products indicated in the purchase proposal submitted by the Customer is subject to the availability of the products in stock.
Shop.uffizi.it undertakes to promptly inform the Customer of any unforeseen stock shortages due to excess demand or other causes. In order to maintain service efficiency and where conditions permit,
Shop.uffizi.it reserves the right to use the
express carrier of its choice.
Shop.uffizi.it delivers the products to the address indicated by the Customer within the timeframes specified in the shipping details via carrier or, in any case, within 30 (thirty) days from the conclusion of the Contract. No liability can be attributed to
Shop.uffizi.it in the event of a delay in processing the order or in delivering the ordered products due to shortcomings or failures on the part of the carrier.
Delivery costs
Delivery costs are borne by the recipient and are clearly indicated at the time of ordering, without prejudice to any promotional initiatives providing for delivery costs to be borne by
Shop.uffizi.it. Such promotions, where applicable, will be indicated on the website and clearly described according to their specific terms and conditions, depending on the promotion in progress. Payment for the goods by the Customer will be made using the method chosen at the time of the order.
Import duties
Any
customs duties and/or additional sales taxes required for importing goods into the USA and other non-EU countries are borne by the recipient. Any additional charges relating to customs clearance operations shall be borne exclusively by the recipient of the shipment.
In the event of failed customs clearance,
Shop.uffizi.it will refund only the cost of the product and not the shipping costs.
Delivery methods
Delivery of the goods is understood to be “kerbside” (street level) unless otherwise indicated, such as:
- A different communication at the time the order is finalised;
- Any specific methods provided for in the product’s technical sheet;
- The explicit purchase of delivery to the floor, where available.
At the time of delivery of the goods by the carrier, the Customer is invited, and in any case required, to check:
- That the number of packages actually delivered corresponds to the number indicated on the transport document;
- That the packaging of the packages is intact in all its parts, not damaged, nor compromised by weather events or otherwise altered.
Important: any damage to the packaging and/or the product or any discrepancy in the number of packages or in the indications must be immediately reported by placing a
written reservation of inspection (specifying the reason for the reservation, e.g. “damaged packaging”, “crushed packaging”, etc.) on the carrier’s delivery receipt. Once the carrier’s document has been signed, the Customer may no longer raise any objections regarding the external characteristics of the goods delivered. Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days from delivery, in accordance with the procedures set out in this document.
Non-collection
If the goods are not collected within 5 working days and remain in storage at the carrier’s warehouse due to repeated failure to deliver to the address indicated by the Customer at the time of the order, the products will be returned to the warehouses of
Shop.uffizi.it. New arrangements will be made for reshipment and the related additional shipping costs.
Article 9 – Right of withdrawal
9.1. Right of withdrawal
If the Buyer is a
Consumer (i.e. a natural person who purchases the goods for purposes not related to their professional activity and who does not indicate a VAT number in the order form to the Supplier), they have the right to
withdraw from the purchase contract for any reason, without having to provide any explanation and without any penalty, within 14 days from the date of receipt of the goods. The right of withdrawal applies to the product purchased by the Consumer in its entirety. It is not possible to exercise the right of withdrawal only on part of the product purchased (e.g. accessories, attachments, movable parts, etc.).
9.2. Procedures for exercising the right of withdrawal
To exercise the right of withdrawal, the Consumer must send the
Supplier a written communication within 14 days from the date of receipt of the goods, by PEC (certified e-mail) or registered letter with return receipt to the addresses indicated in Article 1. The registered letter shall be deemed sent in due time if it is delivered to the accepting post office before expiry of the above deadline.
The communication may also be sent within the same time limit by e-mail to:
help@firenzemuseistore.com, but in this case it must be confirmed by registered letter or PEC within the following 48 hours.
Once the communication of withdrawal has been received, the Supplier will promptly inform the Buyer of the instructions regarding the return procedures, assigning a
unique return authorisation code (RMA).
9.3. Effects of withdrawal
In the event of withdrawal, the Supplier shall reimburse the Consumer for
all payments received, including delivery costs, within 14 days from the date on which it is informed of the decision to withdraw.
The reimbursement will be made by cancelling the amount charged to the credit card or by bank transfer. In the latter case, it is the Buyer’s responsibility to promptly provide the bank details on which the refund is to be made (ABI code – CAB code – account number of the invoice holder).
The Supplier may withhold the reimbursement until it has received the goods or until the Consumer has provided proof of having returned them, whichever occurs first.
The goods must be returned intact, complete in all their parts and in their original packaging (bags and boxes), stored and possibly used with due care, without any signs of wear or dirt, in compliance with the conditions indicated above.
If the returned goods are damaged or show signs of wear caused by handling that was not strictly necessary to determine their nature, characteristics and proper functioning, the Supplier will deduct from the refund an amount corresponding to the decrease in value.
9.4. Consumer obligations in the event of withdrawal
The Consumer must return the goods without undue delay and in any case within 14 days from the date on which the withdrawal was communicated, following the Supplier’s instructions. The goods purchased must be returned intact, complete in all their parts and packed in the original and complete packaging (including any documentation and accessories). In order to limit damage to the original packaging, under all circumstances it is recommended to avoid applying labels or adhesive tape directly to the product’s original box. We also recommend that, when returning the goods, the original box be placed in a second box, on which the address of the return recipient should be written.
The shipping costs for returning the goods are borne by the Consumer; any additional costs highlighted at the time of ordering will not be refunded.
The shipment remains under the full responsibility of the Consumer until proof of receipt in our warehouse is provided.
The Supplier shall in no way be liable for damage, theft or loss of goods returned with uninsured shipments; in the event of damage to the goods during transport, the Supplier shall inform the Consumer of the incident (within 5 working days from receipt of the goods in its warehouses), so that the Consumer may promptly lodge a complaint against the chosen carrier and obtain reimbursement of the value of the goods. In such circumstances, the product will be made available to the Consumer for collection, and the request for withdrawal will be cancelled.
Upon arrival at the warehouse, the product will be inspected to assess any damage or tampering not resulting from normal transport procedures. If the original packaging and/or the original packing is damaged, the Supplier will deduct a percentage from the refund due to the Consumer. This percentage (considered as a contribution to restoration costs) shall in any case not exceed 10% of the refund amount.
9.5. Exclusions from the right of withdrawal
The right of withdrawal is excluded in the cases provided for by Art. 59 of Legislative Decree 206/2005, including, by way of example:
- Supply of goods made to the consumer’s specifications or clearly personalised;
- Sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been opened after delivery;
- Goods which are liable to deteriorate or expire rapidly;
- Sealed audio or video recordings or computer software which have been opened by the consumer after delivery;
- Supply of digital content not supplied on a tangible medium, once the performance has started with the consumer’s express consent.
The right of withdrawal is completely excluded, due to the lack of the essential requirement of integrity of the goods (packaging and contents), in cases where the Supplier ascertains even one of the following circumstances:
- Non-diligent use of the goods that has compromised their integrity or the use of any consumable materials associated with the product;
- Lack of the outer packaging and/or the original inner packing;
- Absence of integral components of the product (accessories, cables, manuals, parts, etc.);
- Damage to the product due to causes other than transport, including partial or total tampering with the product or any of its parts.
In the event that the right of withdrawal is forfeited, the goods will remain at the Supplier’s premises, available to the Consumer for collection at their own expense.
Withdrawal procedures
To exercise this right, the Customer must send
Shop.uffizi.it a written communication by e-mail within 14 working days from the date of receipt of the goods. This communication must be sent to:
help@Shop.uffizi.it.
Once the communication of withdrawal has been received, the
Shop.uffizi.it Customer Service will promptly inform the Customer of the instructions on how to return the goods, assigning a
unique RMA code for the return of the goods, which must be received by
Shop.uffizi.it within 14 days from the authorisation.
The goods must be returned intact, complete in all their parts and in their original packaging (bags and boxes), stored and possibly used with due care, without any signs of wear or dirt, in compliance with the conditions indicated above.
Refund
Without prejudice to any restoration costs for damage to the original packaging ascertained by
Shop.uffizi.it, the company will refund the Customer the full amount already paid, within 14 days from the return of the goods, through a procedure to cancel the amount charged on the credit card or by bank transfer. In the latter case, it is the Customer’s responsibility to promptly provide the bank details on which the refund is to be made (ABI code – CAB code – IBAN current account of the invoice holder).
Forfeiture of the right of withdrawal
The right of withdrawal is completely excluded, due to the lack of the essential requirement of integrity of the goods (packaging and contents), in cases where
Shop.uffizi.it ascertains even one of the following circumstances:
- Non-diligent use of the goods that has compromised their integrity or the use of any consumable materials associated with the product;
- Lack of the outer packaging and/or the original inner packing;
- Absence of integral components of the product (accessories, cables, manuals, parts, etc.);
- Damage to the product due to causes other than transport, including partial or total tampering with the product or any of its parts.
In the event that the right of withdrawal is forfeited, the goods will remain at the premises of
Shop.uffizi.it, available to the Customer for collection at their own expense.
Warranty
All products sold by
Shop.uffizi.it are covered by the
manufacturer’s conventional warranty and by a
24-month warranty for lack of conformity, pursuant to Legislative Decree 206/05. In order to benefit from the warranty, the Customer must keep the proof of payment received by e-mail.
The exercise of the warranty may involve requesting assistance from
Authorised Service Centres in the territory and/or following the procedures described in the documentation included with the product.
Lack of warranty coverage
The manufacturer’s conventional warranty is provided according to the procedures described in the documentation included with the product. If, following an intervention by an Authorised Service Centre, the defect is found to be
“not covered by the manufacturer’s conventional warranty”, the costs of inspection and repair requested by the Service Centre, as well as any transport costs incurred by
Shop.uffizi.it, shall be charged to the Customer.
Lack of conformity
The 24-month warranty, pursuant to Legislative Decree 206/05, applies to products that present a
lack of conformity, provided that the product is used correctly, in accordance with its intended use and with the instructions contained in the technical documentation supplied. This warranty is reserved for the
private Consumer (natural person who purchases the goods for purposes not related to their professional activity, i.e. who makes the purchase without indicating a VAT number on the order form). In the event of a lack of conformity,
Shop.uffizi.it will restore, at no cost to the Customer, the conformity of the product by repair/replacement or price reduction, up to and including termination of the contract. If, following an intervention by an Authorised Service Centre, the defect is not found to be a lack of conformity pursuant to Legislative Decree 206/05, any inspection and repair costs requested by the Service Centre, as well as any transport costs incurred by
Shop.uffizi.it, shall be charged to the Customer.
Return
In cases where the application of the warranty entails the
return of the product, the goods must be returned by the Customer in their original packaging, complete in all parts (including packaging and any documentation and accessories: manuals, cables, etc.); to limit damage to the original packaging, we recommend placing it in a second box; under all circumstances, it is advisable to avoid applying labels or adhesive tape directly onto the product’s original box. The Customer will be provided with a return authorisation number (
RMA) which must be indicated on the outside of the package, following the instructions given directly in the relevant authorisation e-mail.
DOA
Replacements in cases of
DOA (Dead On Arrival: product not working on delivery) will only be carried out if expressly provided for by the manufacturer. The time required for replacement or any repair of the product depends exclusively on the manufacturer’s policy.
Failure to repair
If, for any reason, it is not possible to return to the Customer a product covered by warranty (repaired or replaced),
Shop.uffizi.it may, at its discretion, proceed with the
refund of the amount paid, taking into account the use of the product, or with its replacement with a product of equal or higher characteristics.
Timeframes and procedures
The time required for repair or replacement of the product depends exclusively on the manufacturer’s policy and no compensation may be claimed from
Shop.uffizi.it for any delays in carrying out repairs or replacements.
Complaints
Any
complaint must be submitted in writing by e-mail to:
help@Shop.uffizi.it.
Jurisdiction
The distance sale contract between the Customer and
Shop.uffizi.it is deemed to have been concluded in Italy and is therefore governed by
Italian law. If the Customer is a consumer, any civil and/or criminal dispute relating to the application, execution, interpretation or breach of the distance sale contract shall fall under the territorial jurisdiction of the court of the place where the Customer is resident or domiciled, provided that such place is within the territory of the Italian State. In all other cases (e.g. where the Customer has their residence or domicile abroad), the territorial jurisdiction shall lie exclusively with the
Court of Florence.
